1. Criteria for protection:
An industrial designshall be eligible for protection when it satisfies the following conditions:
+) It is novel;
+) It is of a creative nature;
+) It is susceptible of industrialapplication.
2. Requireddocuments:
+) Description.
+) Five(05) sets of photographs/drawings in the same ratio comprising front, back,top, bottom, left, right and perspective views. Dimension of representationshould not be larger than 190mm x 277 mm and not be smaller than 90mm x 120mm.
+) Prioritydocument (if any).
+) Deed of Assignmentof Right to file application (if any).
+) Powerof Attorney (PoA).
+) Pleasenote that the fax copy of PoA is accepted to file with the applicationproviding that the original shall be supplemented within 01 month. Thus, youshould fax us the notarized Power of Attorney first for our early filing andsend the original by mail later for our supplementation.
3. Approximatetime to obtain Design Patent: About 09 months
4. Termof Validity:
+) 5 years (eachterm);
+) 15year (maximum, 2 times of renewal).
5. Renewal:
+) Maximumrenewals: 2 times.
+) Renewalshould be paid within 6 months prior to the expiry date (a grace period of 6months expiry date is available providing that the Design Owner must pay laterenewal fee).
