1. TRADEMARKREGISTRATION AUTHORITY
Lao Department ofIntellectual Property (Hereinafter Lao DIP) is the Authority that deals withall intellectual property matters in Laos.
2. TRADEMARK LAW
The trademark protection is Laos in protected under the Law ofTrademark, Article 5 of Decree of the Prime Minister on Trademarks No06/PM,January 18th 1995.
Lao PDR, uses the First-to-File system. (i.e.Prior use shall not be taken into account). This means, two applicants apply toregister for the same mark, the first application that receives the fillingnumber will be granted the right. All applications have to be sent and examinedby the Lao DIP.
Based on the regulations in Laos,multiple-class is not applied. The trademark owner is required to pay theofficial fee per item class per item mark in all maters related to IP.
2.1. OWNER
Owner of the trademark and/or individual, entity that hasassigned the right for the use and others in relation to the goods/service, hasthe right to register the trademark.
2.2. APPLICANT
(a) Lao Applicant: Shall be able to submit the applicationdirectly to the Lao DIP or through the legal firm.
(b) Foreign Applicant: It is required to have the legal agency thathas local residence in Lao PDR to conduct on behalf of theindividual/firm/proprietor.
2.3. TYPE OFTRADEMARK
A trademark to be registered in Laos can be categorized into fourcategories namely, trademark, service mark, collective mark and figurative mark
